Human rights

HUMAN RIGHTS ARE THE PRINCIPLES OR NORMS THAT DESCRIBE CERTAIN STANDARDS OF HUMAN BEHAVIOR.

So, lets see some of the basic rights that human posses.


1. The right to freedom of religion or conscience.

2. The right to freedom of expression. (SO EXPRESS ANYTHING FREELY!).

3.  The right to privacy. (PRIVACY MATTERS!).

4. The right to property.

5. The right to vote. (BUT AGE SAYS EVERYTHING!)

6. The right to freedom of assembly.

7. The right to an adequate standard of living. (STANDARD OF LIVING IS IMPORTANT!).

8. The right to adequate food, housing, water and sanitation.

9. The rights you have at work.

10. The right to education. (OK THIS ONE IS TOO IMPORTANT).

YOU MAY HEARD ABOUT VARIOUS BILLS PASSED DURING 2019 WHICH CREATES VARIOUS DIFFERENCES IN THE COUNTRY. VARIOUS CONTROVERSIES WERE THERE IN 2019. 

TOTAL BILLS PASSED WERE 59 BILLS WHICH WAS INTRODUCED IN THE YEAR 2019.

Types of contract

NOW LETS SEE SOMETHING ABOUT CONTACTS. DO YOU KNOW THAT THERE ARE VARIOUS TYPES OF CONTACTS.
YES! 


THE INDIAN CONTACT ACT:
          
            The Indian contact act, 1872 April 25, prescribes the law relating to contracts in India. It is enacted by Imperial legislative council which is commenced on 1 September 1872.


NOW LETS JUMP INTO THE TYPES OF CONTACT:

Contacts under seal:
      
       Traditionally a contract was an enforced legal document only if it was stamped with a seal. But now courts recognizes informal contracts too. So contracts under seal lost its value. (NO VALUE FOR SEAL BUT STILL ORIGINAL!).

Express contracts:

      In express contracts the parties states the terms, either orally or in writing at the time of its formation.( SO, SIGN IN YOUR CONTACT ORALLY!).

Implied contracts:

       Implied contracts consists of obligations arising from a mutual agreement and intent to promise which have not been expressed in law.( EVERY THING MUTUALLY!).

Unconventional contacts:

      A unconventional contact is unjust or unduly one-sided in favor of party, who has the superior bargain power.( ITS ALL ABOUT THE ULTIMATE POWER!).

Void and voidable contact:

     A void contact imposes no legal rights or obligations upon the parties and is not enforceable by the court. It is in effect no contact at all.

    A voidable contract is legally enforceable agreement. A voidable contract is legally enforceable agreement. A voidable contract may be ratified either express or implied by the party who has the right to avoid it.

There are also some other types of contacts.

Trademark infringement


Do you know what is 'TRADEMARK'. Trademark identifies as the product belongs to a particular company which recognizes its ownership. Trademark can be a logo, name of the company, a slogan or brand.

NOW LETS TALK ABOUT TRADEMARK INFRINGEMENT!

Trademark infringement is the violation of rights of the trademark of the particular company without authorization of the trademark owner.






Now lets see some of the trademark infringement activities. 

    Unauthorized person which means a person who is not the owner or the licensee of the registered trademark using it comes under trademark infringement.( NO UNAUTHORIZED ENTRY!).
   



    Do you know that same kind of trademark logos or something like that comes under trademark infringement .If the consumers are likely to get confused between the two marks then there is an infringement. ( STILL IN CONFUSION?)
  


    You can only infringe a registered trademark. For an unregistered Trademark, the common law concept of passing off will apply. So if you are starting a business try to register your brand name first. (REGISTRATION IS MORE IMPORTANT THAN ANYTHING ELSE!) 
  


    Do you know that to establish infringement even to the goods/ services of the person of infringement must be identical with or similar to the goods that the registered Trademark represents.
Any unauthorized use of the exclusive statutory rights of a registered trademark constitutes infringement.( THAT'S WHY A BRAND IS A BRAND!)

Cyber bullying in India

Cyber bullying takes place over electronic devices. It can occur through various means. Cyber bullying is common through social media and through many digital spheres.



Now lets see some laws regarding to cyber bullying.

1. Identity theft is one of the major cyber bullying activity.(sec.66C).

2. Do you know leaping in others privacy is an offense, violation of privacy(sec.66E).



3. Breach of confidentiality and privacy is punishable.(sec.72). (HIGHLY CONFIDENTIAL!).

4. PIRACY is also an offense according to the copyright act.





FYI:
    Do you know what is PIRACY, piracy means unauthorized use or reproduction of another's work. ( SO FROM NOW YOU CAN ALSO UNDERSTAND THE WORD WHAT PIRATES MEANS ITS STEALING!).


5. Do you know that stalkers and contacting or attempting to contact a women is an offense.(sec.354D). (NO STALKING IS ALLOWED!)

6. Most of the people knows about Email spam. But there is another serious offense which is sending threatening messages through Email. (sec.503).

7. From the above line you can know that Email to has some serious problems. Absolutely a big YES! there is also another offense Email abuse. ( sec.500).

Things that are prohibited in public places in India

Do you know that doing certain things in public is an offence.

Doing so you can get fined.

lets see what are the some of these things.



1. CONTROL YOUR SPEED:

           Do you know that according to traffic laws in India, over speed is an offense. So it has certain speed limits  and overtaking from the wrong side is also an offense.
         (SO NO NEED FOR SPEED!).



2. SMOKING IS INJURIES TO HEALTH!
        
          Everyone in India mostly know this, in India smoking in public places is prohibited. This prohibition is started from the day October 2008.
    (SO SMOKING ALSO AFFECT OTHERS!).


3. STOP LITTERING!

        Littering the streets is a punishable offense in many cities in India. Even urinating and spitting in public is offense in some Indian cities.


4. PLAYING LOUD MUSIC!

       Do you know that no one claim a right to create noise even in his own premises which causes nuisance to neighbors or others.
     (NO NOISE PLEASE!)

5. SECTION 294 OF THE INDIAN PENAL CODE(IPC)  if you found involved in "obscene activity" at a public place , you can be imprisoned for 3 months.
